By completing your purchase, checking the acknowledgment box, and submitting payment, you (“Buyer”) agree to the following legally binding terms and conditions with THE AERIAL ILLUSIONS COMPANY LLC (“Seller”).

1. PRODUCT DESCRIPTION

Each Spiral Apparatus (“Product”) is a patented, all-one-piece welded steel aerial apparatus designed and manufactured by THE AERIAL ILLUSIONS COMPANY LLC.

- Base Finish: Steel (optional pre-taping in Buyer’s color choice included)
- Design: Continuous steel spiral structure with full-penetration welds engineered for aerial performance
- Intended Use: Professional pole and aerial training and performance applications
- Load Capacity: Welds are rated to hold up to 5,000 lbs of static load
- Expected Lifespan: 5 years or 10,000 working hours, whichever comes first, under normal professional use and maintenance

2. ACCEPTANCE OF RISK

By purchasing this Product, Buyer acknowledges that pole and aerial arts are inherently physical and carry risk of injury or death. Buyer voluntarily assumes all risks associated with installation, use, and instruction involving the Product.

Buyer certifies that they (and any students or performers using the Product) will have appropriate training, supervision, and installation standards in place.

3. INSTALLATION & MAINTENANCE REQUIREMENTS

- Product must be installed and load-tested by a qualified professional rigger or installer.
- Seller provides written Installation & Maintenance Instructions, which Buyer agrees to follow in full.
- Failure to adhere to these guidelines voids all warranties.
- Buyer agrees to routinely inspect for wear, corrosion, tape damage, or structural stress before each use.

4. LIMITED WARRANTY

Seller warrants that each Product will be free from defects in materials and workmanship for five (5) years or 10,000 working hours, whichever occurs first.

WARRANTY COVERAGE:
- Structural integrity of steel and welds under normal use

WARRANTY EXCLUSIONS:
- Misuse
- Improper installation, modification, or unauthorized repair
- Rust, corrosion, or surface wear from environmental exposure
- Cosmetic damage, taping, or adhesive wear
- Use for unapproved rigging, outdoor installations, or uninspected ceiling mounts

REMEDY:
If a valid claim is made, Seller may, at its discretion, repair, replace, or credit the defective Product.
Buyer is responsible for all shipping and handling charges related to warranty claims.

5. LIABILITY LIMITATION

- Buyer releases, indemnifies, and holds harmless Seller, its officers, employees, and affiliates from all claims, injuries, losses, or damages arising out of use, installation, or operation of the Product.
- Seller shall not be liable for any incidental, consequential, or indirect damages, including but not limited to personal injury, lost profits, or property damage.
- Seller’s total liability shall not exceed the purchase price of the Product.

6. NO MODIFICATION OR REVERSE ENGINEERING

The Product’s design, construction, and instructional materials are protected by patent and trade secret laws. Buyer shall not reproduce, reverse engineer, modify, or create derivative works based on the Product without prior written consent from THE AERIAL ILLUSIONS COMPANY LLC.

7. RETURN & CANCELLATION POLICY

- All Spiral sales are final.
- Orders canceled prior to shipment are subject to a 20% restocking and administrative fee.
- Pre-sale deposits are non-refundable but may be transferred to another Buyer with Seller’s approval.

8. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Florida, with exclusive jurisdiction and venue in Lee County, Florida.

9. ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties. By completing the purchase, Buyer acknowledges that they have read, understood, and agreed to all terms herein.

2) Safety Disclaimer
Aerial arts involve inherent risk of injury or death. Installation, inspection, and supervision must be
performed by qualified professionals. Failure to follow this manual voids warranty and may result in
serious injury. Comply with local building codes and facility safety policies. Always use rated
commercial aerial hardware. Use appropriate crash mats during training or rehearsal.

3) Pre-Installation Checklist
Confirm all items before installation: • Structure Capacity: Overhead support rated to ≥ 5× combined
apparatus + user load (minimum 1,250 lbs). • Ceiling Height: Recommended 10–14 ft; minimum 8 ft
from floor to top mount. • Hardware Ratings: Swivels, carabiners, quick links, and shackles ≥ 5,000
lbs static rating; forged steel, locking gates. • Clearances: ≥ 5 ft radius free of walls, mirrors,
sprinklers, and lighting. • Mats: ≥ 2 in. thick landing pad under apparatus during training.

4) Installation Instructions
Step 1 — Unpack & Inspect • Remove packaging; verify serial number and inspection tag. • Check for
shipping damage, cracks, bends, or weld defects. • Do not install if any issues are present; contact
support. Step 2 — Select Mounting Point • Use only structural beams/truss or engineered aerial
mounts. • Do not mount to drywall, suspended ceilings, or non-load-bearing elements. Step 3 —
Attach Hardware • Connect the Spiral’s top attachment point to the anchor with rated hardware. •
Install a high-load swivel if rotational use is desired. • Ensure gate closures are locked; verify free,
vertical hang. Step 4 — Static Load Test • Hang 2–3× expected user body weight for 60 seconds. •
Observe for movement, creaks, or deformation. • Record date/results in the Maintenance Log
(Section 9). Step 5 — Final Safety Check • Confirm clearances, mats, lighting, and floor conditions. •
Brief users on rules, weight limit, and spotter protocols.

6) Maintenance & Inspection

inspection. • Replace all hardware annually. • Record all inspections. Immediately remove from
service if any weld cracking, bending, corrosion, or hardware failure occurs.
